PRIVACY POLICY
- „Retiva“ (toliau – Bendrovė arba „Retiva”), priklausantis juridiniam asmeniui UAB „Retiva“, kuris jį valdo ir naudoja Lietuvos Respublikos teisės aktų nustatyta tvarka.
- „Retiva” gerbia ir suvokia ypatingą svarbą, tenkančią Jūsų asmens duomenų apsaugai, todėl renka ir tvarko tik tuos Jūsų duomenis, kurie reikalingi vykdant Bendrovės veiklą. Asmens duomenys tvarkomi teisėtai, skaidriai ir sąžiningai, iš anksto nustatytais tikslais ir tik tokia apimtimi, kuri reikalinga tikslams pasiekti. Tvarkydami asmens duomenis, siekiame, kad jie būtų tikslūs, saugūs, konfidencialūs, tinkamai laikomi ir saugomi.
- When processing your personal data, we comply with the provisions of the General Data Protection Regulation (hereinafter referred to as "GDPR"), the Law on Legal Protection of Personal Data of the Republic of Lithuania (hereinafter referred to as "LPP"), the Law on Electronic Communications of the Republic of Lithuania (hereinafter referred to as "LEC"), as well as with the provisions of any other directly applicable legal acts governing the protection of personal data.
- The following GDPR principles apply to the processing of personal data: purpose limitation (Processing of Data only for the purpose originally stated); data minimisation (Only as much Personal Data as necessary); lawfulness, fairness and transparency; accuracy; limitation of retention period (Only kept for as long as is necessary for the specific purpose); integrity and confidentiality; and the principle of accountability (The Controller shall provide evidence of compliance with its obligations).

Personal data - any information relating to an identified or identifiable natural person (data subject); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, a personal identification number, location data and an online identifier, or to one or more factors specific to the natural person's physical, physiological, genetic, mental, economic, cultural or social identity.
Person - any natural person whose Personal Data is processed (data subject), e.g. a Potential Candidate, Candidate, Employee, employee of the Administration or any other natural person.

Data recipient - the natural or legal person, public authority, agency or other body to which the personal data are disclosed, whether or not to a third party.
Data Subject - the natural person whose personal data is collected on the Portal.
Submission of data - disclosure of personal data by transmission or otherwise making them available (except publication in the media).
Data processing - any operation or sequence of operations which is performed upon personal data or sets of personal data, whether or not by automated means, such as collection, recording, sorting, organisation, storage, adaptation or alteration, retrieval, access, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination with other data, restriction, erasure or destruction.
Data Processor - a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
Data Controller - UAB „Retiva“, a company incorporated under the laws of the Republic of Lithuania, code 304850497, registered office at Išradėjų g. 11A, Šiauliai, LT-78149, Republic of Lithuania, the data about which are collected and stored in the Register of Legal Entities.
COLLECTION OF PERSONAL DATA
We process the personal data we receive from you in the following ways:
- When you submit them to us. You provide us with your personal data when you send us your CVs, cover letters, apply for our job vacancies on job search portals, through our website, social networks or other platforms, register on our websites, communicate with us by phone, email or in meetings, answer questionnaires, take assignments or tests, or contact us through the integrated website online chat app, sharing your success stories and giving feedback about us. If you contact us in writing or electronically, we will save the details of the correspondence.
- When you use the websites we operate, certain information (e.g. Internet Protocol (IP) address, the device used, the web browser used, the number of visits, the pages viewed on our website, the amount of time spent on the website, the websites you visited before you came to our website) is collected automatically.
- When we receive your personal data from other persons in accordance with the procedure established by law and/or this Privacy Policy. We may combine the personal data we receive from you with data collected by us from other public or accessible sources (e.g. CV Bank, Lithuanian Employment Service, etc.). We may combine the personal data you provide with data obtained through the use of cookies on websites, data collected in connection with the provision of our services to you, or with data lawfully obtained from third parties. In exercising your rights, you will always be able to request the rectification of incorrect personal data. In exceptional cases, if special categories of Personal Data are processed, such as information on criminal records, health, trade union membership, etc., the Administration staff shall additionally check whether all the necessary steps have been taken and take additional steps (e.g. obtaining separate consent for processing) and measures (e.g. not storing in the Controller's database or in the applications used) where necessary.
PURPOSES AND GROUNDS FOR PROCESSING PERSONAL DATA
1. Your personal data is processed in accordance with the following main grounds for processing personal data set out in the GDPR:
1.1. for the performance of a contract or to take action at the request of the data subject prior to entering into a contract;
1.2. With the consent of the data subject;
1.3 Where processing is necessary for compliance with a legal obligation to which we are subject;
1.4 Where the processing of personal data is necessary for our legitimate interests or those of a third party.
2. We process your personal data for the following purposes:
2.1. For the purpose of providing services. We process your personal data in order to provide our services to you and others: to find and select candidates who match our clients' needs, to assess candidates' suitability for the job offered and to introduce candidates to employers or to recruit them for our company.
For this purpose, we process your personal data obtained from you (e.g. data provided by you in your CV, data collected during communication and other data necessary for your employment), collected through your use of our and other websites and/or obtained from other persons (e.g. recommendations from current or former employers or acquaintances, recommendations from social networks, mass media, etc).
For this purpose, we provide or transfer your data to our partners and clients - employers who are looking for employees. We will not transfer more of your personal data to our clients than we process on the basis of this Privacy Policy. We have entered into agreements with our clients, whereby both parties undertake to protect your personal data.
For this purpose, we process your data until the service is provided to you. If your personal data is processed in connection with the provision of services to other persons, with your consent, we will process your personal data for a period of 3 years from the date of receipt of your consent.
As part of our services, we may, with your consent, carry out assessments and testing of you (the candidate) and film the assessments and testing. The video recordings and the results of the assessments/tests may be shared with our client who has requested the specific selection.
You have the right to view video recordings, test results, assessment results, and to request that a video be recorded on digital media.
We will process video recordings, test results, assessment results for the duration of a specific selection or, with your consent, for the purpose of administering the candidate database for a longer period of time as specified in this Privacy Policy. If we determine that there is reason to believe that a video recording contains evidence of a crime or other unlawful act or an internal investigation has been opened, the video recording will be retained until the conclusion of the relevant investigation and/or proceeding.
2.2. For the purpose of administering the candidate database. Pasibaigus konkrečiai atrankai, į kurią Jūs teikėte savo duomenis, gavę Jūsų sutikimą, mes tvarkome Jūsų asmens duomenis tam, kad galėtumėme ateityje pasiūlyti Jums darbą ir karjeros galimybes, surasti atitinkančius mūsų klientų poreikius kandidatus bei juos atrinkti, įvertinti, ar kandidatai tinka siūlomam darbui, ir pristatyti kandidatus darbdaviams. For this purpose, we process the same personal data as for the purpose of providing the services, provide it to the same persons and keep it for 3 years after obtaining your consent.
2.3 We also process the personal data of the person you recommend for the purpose of selection for a job offered by us or our partners, and your (the recommender's) personal data for the purpose of administering the bonus for the recommended person.
For this purpose, we process the following personal data of the recommender: name, surname, telephone number, email address, work experience, qualities, talents, other information provided; personal data of the recommender: name, surname, telephone number, email address, data necessary for the payment of the prize, the IP address of the server that sent the email, the IP address of the device from which the email was sent, the source of the data (from where the data was obtained, the name of the source, the date on which it was received, and the person that entered it).
We will process the data of the recommended person for 3 years from the date of consent. We will process the personal data of the recommender during the selection process of the recommended person (if the recommended person is not recruited) or for 3 years after the payment of the bonus (if the recommended person is recruited).
Jūsų nurodytus rekomenduojamo asmens duomenis atrankos į „Retiva” ir/ar jos partnerių siūlomą darbo vietą tikslu, „Retiva” gali perduoti potencialiems darbdaviams visame pasaulyje, įskaitant ir esantiems valstybėse, kurios teisės aktai neužtikrina Lietuvoje galiojančio asmens duomenų teisinės apsaugos lygio. Asmens duomenis perduodant gavėjui į tokią valstybę, „Retiva” ir asmens duomenų gavėjas taikys tinkamas apsaugos priemones, kad asmens duomenys būtų apsaugoti nuo neteisėto tvarkymo. Sutikime nurodytus asmens duomenis minimalia būtina apimtimi taip pat galime perduoti trečiajam asmeniui, teikiančiam paslaugas „Retiva” , įskaitant teisės, mokesčių, verslo ar personalo administravimo, buhalterinės apskaitos patarėjams bei teisės aktų nustatyta tvarka kompetentingoms valstybės institucijoms.
2.4. For the purpose of service quality control (phone call recording). When you call us or we contact you, we may record our conversation in order to ensure the quality of our service and to monitor our service delivery.

For this purpose, we obtain your personal data from you or generate it when you use our services.
For this purpose, we keep your data for 1 year.
2.5. To administer staff work activities. To the extent that we are obliged or permitted to do so by law, we process the personal data of our employees in accordance with our internal rules.
2.6. To improve the websites we manage and to offer you a better and more tailored service. We use your personal data, including the personal data we receive when you use our websites, to improve and develop these websites and to offer you better and more personalised services.
2.7. For direct marketing purposes. We process your personal data with your consent in order to offer you our services, those of our affiliates and partners, and to improve our services.

2.8. For face-to-face communication and to improve service quality. For this purpose, we process the personal data you provide when you contact us online chat app, by leaving a review about us or sharing your success story in the reviews section of the website. For this purpose, we process your personal data such as your email address, Meta or Google account name, and the text of the review.
For this purpose, we process your data for 1 month from the beginning of the correspondence.
- Where your personal data is processed with your consent, your personal data shall no longer be processed after you have withdrawn your consent or after the expiry of the term of validity of your consent, except for the storage of data evidencing that consent has been given for a maximum period of 10 (ten) years for the purpose of asserting, exercising or defending our legal claims.
- We do not process your personal data for any other purposes incompatible with the above.
2.9. For the purpose of selecting candidates. We reserve the right to contact only selected candidates who apply for the vacancies. The information provided by candidates will only be used for selection purposes and will be kept confidential. Candidate's data will only be kept for as long as is necessary for the selection process and will then be removed or archived in accordance with the applicable legal requirements. For this purpose, personal data may be transferred to third parties („Retiva” to the client) that are directly related to the job advertisement for which the person applied.
PROCESSING OF PERSONAL DATA FOR DIRECT MARKETING PURPOSES
- With your consent and in accordance with the provisions of the GDPR and the EIR, we may use your personal data for the purpose of direct marketing in order to provide you with offers and information about our goods and/or services, those of our affiliates and partners, which we believe may be of benefit to you.
- For this purpose, we process the following personal data: name, surname, telephone number, email address, date of birth, place of residence (address), IP address, education, gender, position, workplace, profession, work experience.
- You can choose whether you allow us to use your personal data for direct marketing purposes. You can do this in the ways mentioned in section 2.7 and, if we are not able to provide you with a service at this time, to offer to provide you with services in the future using marketing tools.
- By granting us the right to process your data for direct marketing purposes, you also grant us permission to contact you by means of communication (e.g. by email, telephone, SMS or other means of communication such as Viber, Messenger, etc.) for this purpose.
- We may combine the information we hold about you with information lawfully held by third parties.
- If you consent to the use of your personal data for direct marketing purposes, we may use your personal data to analyse and improve the effectiveness of our websites, social media channels and market research, and for other company marketing and sales purposes. In this case, we will use your personalised data.
- Even if you have given your consent to the processing of your personal data for direct marketing purposes, you can withdraw this consent at any time for all or part of the processing of your personal data. You can do this in the following ways:
7.1. notify you of your unsubscription in the manner indicated in the email notifications and/or offers (e.g. by clicking on the „unsubscribe“ link in the newsletter, etc.);
7.2. by coming to us and making a request. The request must clearly state your name. If you wish to withdraw your consent in this way, we may ask you to provide proof of identity;

8. If you withdraw your consent, we will stop processing your personal data for the purpose of direct marketing as soon as possible.
9. Withdrawal of consent does not automatically oblige us to destroy your personal data or to provide you with information about the personal data we process, so if you wish us to do the same, you must make a separate request.

- „Retiva” savo programose, tinklapiuose, elektroniniuose laiškuose ir internetiniuose skelbimuose naudoja slapukus ir kitas identifikavimo technologijas.

RIGHTS OF DATA SUBJECTS
1. 1.1. Know (be informed) about the processing of personal data;
1.2. to know your personal data and how they are processed;
1.3. to request the rectification of inaccurate personal data concerning you, as well as to request the completion of incomplete personal data concerning you.
1.4 Request that the Company erase personal data relating to you if:
1.4.1. they are no longer necessary for the purposes for which they were collected or otherwise processed;
1.4.2. you withdraw your consent and there is no other legal basis for processing your personal data;
1.4.3. the processing of personal data was unlawful;
1.4.4. on other grounds set out in the Regulation.
2. Request the Company to restrict the processing of your personal data where:
2.1. you contest the accuracy of the data for a period of time within which the controller may verify the accuracy of the data;
2.2. the processing of personal data is unlawful and you do not consent to the erasure of the data;
2.3. the Company no longer needs the personal data for the purposes of the processing, but needs it for the establishment, exercise or defence of legal claims against you;
2.4. you have objected to the processing of your personal data, pending verification that the Company's legitimate reasons override your reasons.
3. Receive personal data relating to you that you have provided to the Company in a structured, commonly used and computer readable format.
4. To object to the processing of personal data relating to you.
5. We will endeavour to guarantee the exercise of your rights as a data subject and to provide all the conditions for the effective exercise of those rights, but we reserve the right not to comply with your requests where it is necessary to ensure:
5.1. to comply with the legal obligations imposed on us;
5.2. national security or defence;
5.3. public order, the prevention, investigation, detection or prosecution of criminal offences;
5.4. important economic or financial interests of the State;
5.5. the prevention, investigation and detection of breaches of official or professional ethics;
5.6. the protection of your rights and freedoms or the rights and freedoms of others.
6. You may submit claims relating to the exercise of your rights to us in person, by post or by electronic communication. Upon receipt of your request, we may ask you to provide proof of identity, as well as other additional information we require in connection with your request.
7. Upon receipt of your request, we will respond to you no later than 30 calendar days from the date of receipt of your request and the submission of all the documents necessary to provide the response.
8. If we deem it necessary, we will suspend the processing of your data, except for storage, until your request is resolved. If you lawfully withdraw your consent, we will cease processing your personal data immediately, but no later than 30 calendar days, except in the cases set out in Section 7.1.8 of this Privacy Policy and as provided for by law, i.e. where we are obliged to continue to process your personal data by applicable law, by a legal obligation to which we are subject, by a judicial decision or by a binding order from an authority.
9. If we refuse to comply with your request, we will clearly state the reason for such refusal.
10.If you believe that your personal data is being processed unlawfully, you have the right to lodge a complaint with the State Data Protection Inspectorate.
PROVISION OF PERSONAL DATA
- We guarantee that your personal data will not be sold, provided or otherwise transferred to third parties without lawful basis, or used for purposes other than those for which they were collected. We will not transfer your personal data in any way other than in accordance with this Privacy Policy and the law. However, we reserve the right to disclose information about you if we are required to do so by law or if we are requested to do so by lawful authorities or prosecuting authorities.
- We may transfer your personal data to companies belonging to the Laista, UAB group (including Retiva UAB), as well as to companies assisting us in our activities (partners, customers, suppliers). We require such partners to process your data only in accordance with the instructions we have given them and in accordance with applicable data protection legislation.
- The above service providers are limited in their ability to use your data and cannot use it for purposes other than to provide services to us.
- A non-exhaustive list of persons and categories of persons to whom we transfer your personal data is set out in Section 2.2 of this Privacy Policy separately for each purpose of use of personal data.
STORAGE OF PERSONAL DATA
- We will not keep your personal data for longer than the purposes of processing or the law requires, unless a longer retention period is specified in the law.
- We aim not to store outdated, irrelevant personal data, so that only relevant information is stored when it is updated (e.g. when your account is revised, information is changed, etc.). Historical information is kept where it is necessary for the purposes of the law or for the conduct of our business.
- Section 2.2 of the Privacy Policy specifies the retention periods of your personal data separately for each purpose of personal data use.
- The data we collect from you will be located within the European Union, but may be transferred or stored outside the EU. It may also be processed by our or our suppliers' staff working outside the EU. When we transfer your data outside the EU, we will take all necessary steps to ensure that your data is processed securely and in accordance with this Privacy Policy.
- Unfortunately, the transmission of information over the internet is not completely secure. Although we take great care to protect your personal data, we cannot guarantee the security of the data when you transmit data to websites - you bear the risks associated with transmitting data to websites. Once we receive your data, we will apply strict procedures and security measures to protect your data from unauthorised access.
- In the unlikely event that we become aware of a breach of security of your personal data which may pose a serious threat to your rights or freedoms, we will inform you immediately upon becoming aware of it and identifying the information accessed.

If you follow such links to any of these sites, please note that these sites and the services available through them have their own separate privacy policies and we do not accept any responsibility or liability for these policies or for the personal data, such as contact or location data, collected on these sites or through these services. Please review these policies before submitting personal data to these websites or using any services.
